Attorney General Jerry Brown Asks California Supreme Court to Overturn Prop 8

California Attorney General Jerry Brown asked the California Supreme Court to overturn Prop. 8.  AG Brown supports same-sex marriage, but until now he claimed it was his job to defend Prop. 8.  We here at Johnny California have argued all along that the Attorney General is under no duty to defend a law he believes to be unconstitutional.  We’re glad to see that he agrees with us.  What turned him around?  Well, first, Jerry Brown knows it’s the right thing to do.  Second, he’s running for Governor in 2010 — he’s gotta start making some big moves, ya know?  

We’ll do a full analysis of the argument once we read through the brief and analyze it (it’s 111 pages long — we’ll need a little time).  But the basic argument is that the California Constitution protects “inalienable” rights (rights that nobody can take away), since Prop 8 takes away the inalienable right to “liberty” and “privacy” it’s unconstitutional.  This is a broad big-picture, swing-for-the-fences kind of argument. 

Good for you Jerry Brown.  This almost makes up for your ridiculous war on alcohol-based energy drinks.

In other news, the Yes-On-8ers filed a brief opposing AG Brown’s argument (obviously).  The Yes-On-8ers also want to nullify the 18,000 pre-Prop 8 same-sex marriages.  Oh, and in March, guess who is going to argue the case to the California Supreme Court on behalf of the Yes-On-8ers:  Ken Starr. Yep, that Ken Starr.

    The people have spoken. Why is this so hard to understand. Democracy is for the people, not the whiners. I just don’t get why you think you have the right to tell the poeple that their vote does not matter.

    After AG Brownose overturns Prop. 8, maybe God (who still owns the title deed to Planet Earth along with a few rights of His own) will suddenly overturn the State of California! And when He does, do you suppose that Brownose will try to overturn God? It sure will be exciting to see who wins! Dr. Know

    I keep hearing that tune, well just this little part, “Chicago, Chicago” How strange. I don’t know what contributions caused him to do a sudden reverse. Just reread my sentence and see that I typed contributions. I don’t know what caused me to write that because what I should of wrote was “contributed”. Oh heck, that even doesn’t sound right now. Who knows?

    prop 8 was voted on by the people of california and those who think they are being discriminated against can go somewhere else if you feel that strongly about it,but you wont do that because besides one or two states in the whole country is the only place that thinks your sick way of life is acceptable,get over it and go back in the closet!!!!!
